These terms and conditions ("Terms") govern your use as a consumer ("Customer") of the website www.collagedepot.nl and related webpages ("the Website"). By placing an order on the Website, you agree to these Terms. An agreement is concluded between the Customer and CollageDepot BV, established in the Netherlands ("CollageDepot"). All contact information and additional details about CollageDepot can be found on the Website. These Terms apply exclusively to consumers and orders placed on the Website.

1. APPLICABILITY AND CUSTOMER INFORMATION

1.1. To place an order on the Website, the Customer must be at least 18 years of age. CollageDepot reserves the right to refuse or modify orders if the Customer provides incorrect personal information or has payment problems.

1.2. CollageDepot is not liable for any errors on the Website, including incorrect prices, technical specifications, or product descriptions. All images are for illustrative purposes only and may differ from the actual product. The Website and its content are the property of CollageDepot or its licensors and are protected by intellectual property rights.

2. ORDERS AND AGREEMENTS

2.1. By accepting these Terms and Conditions, the Customer agrees to their full use and to CollageDepot's privacy policy. A purchase agreement is only concluded after CollageDepot confirms the order via email.

3. CUSTOMER DATA AND ACCOUNTS

3.1. The Customer is responsible for the accuracy of the personal data provided. Sharing login details with others is not permitted, and the Customer must immediately inform CollageDepot if they suspect unauthorized access to their account.

3.2. In case of suspected misuse or violation of the Terms and Conditions, CollageDepot reserves the right to block the Customer's account and assign new login details.

4. Prices, Costs and Payment

4.1 Orders placed on the Website are subject to the prices listed on the Website. Prices are in euros and include VAT. Prices exclude payment and shipping costs, which are listed separately.

4.2 The Website describes the Customer's payment methods. Further information regarding payment options can be found here. CollageDepot reserves the right to require payment in advance for the order, unless the Customer has selected payment by invoice or a similar payment method and CollageDepot has accepted this option. When paying by invoice or in installments, CollageDepot or its partner may conduct a credit check on the Customer. If this is the case, the Customer will be informed. CollageDepot reserves the right not to offer all payment methods at all times. CollageDepot also reserves the right to change the payment method selected by the Customer at the time of purchase if that method is not suitable for any reason. Any restrictions regarding payment options are stated on the Website.

4.3 Payments must be made in accordance with the instructions on the website during the ordering process. Payment can be made using accepted credit cards, debit cards, or other payment methods available at the time. By placing an order, you authorize CollageDepot to charge the payment to your chosen payment method.

4.4 If payment is unsuccessful due to incorrect payment information, insufficient funds, or other reasons beyond CollageDepot's control, we reserve the right not to process or deliver the order until payment is received. We will contact you to resolve the payment issue and provide further instructions.

4.5 CollageDepot reserves the right to change prices at any time without prior notice. Such changes will not affect orders already placed and confirmed by CollageDepot.

5. Delivery

5.1 Delivery will be made in the manner stated on the website and during the ordering process. The estimated delivery time is provided on the website and is merely an indication. CollageDepot is not liable for delivery delays beyond our control, such as delays due to courier services, customs clearance, or force majeure.

5.2 Once your order has shipped, you will receive a shipping confirmation with tracking information, if available. Risk of loss or damage to your order passes to you upon shipment.

5.3 Any customs fees, taxes, or import duties levied upon delivery are the customer's responsibility. CollageDepot is not responsible for such charges and cannot predict their amount, as they depend on the destination and applicable laws.

5.4 If you haven't received your order within the estimated delivery time, please contact us for further assistance. We'll do our best to check the delivery status and resolve any issues.

6. Return of Products and Right of Withdrawal

6.1 Reflection Period: For non-personalized products, you have the right to cancel the agreement within 14 days of receiving the product without giving any reason. The reflection period begins on the day you, or a third party designated by you, receive the last product in your order.

Most of CollageDepot's artworks are Produced to order, based on your personal choices such as size, material, colour, frame or hanging system.
These products are therefore regarded as custom-made or as products with a clearly personal character, as referred to in Article 6:230p sub f under 1° of the Civil Code.
For such products, returns or cancellations are not possible once production has started.
Not in original condition, damaged or incomplete, or with the protective film (if applicable) removed.

6.3 Care during the cooling-off period: During the cooling-off period, you must handle the product and its packaging with care. Any diminished value due to careless handling may be charged.

6.4 Notification: If you wish to exercise your right of withdrawal for a non-personalized product, you must clearly notify CollageDepot of this within the cooling-off period via service@collagedepot.com or via the contact form on our website.

6.5 Returns: After notification, the product must be returned or handed in as soon as possible, but no later than 14 days. The product must be returned with all accessories, in its original condition and packaging, in accordance with our instructions.

6.6 Return options: You can return your artwork free of charge by dropping it off at our depot. For other return methods, our customer service team will be happy to inform you about the options. The consumer is responsible for arranging transport to the depot or shipping.

6.7 Refund: After receiving and inspecting the returned product, or after you have demonstrated that you have sent the product, CollageDepot will refund the purchase price (including any standard shipping costs for the outward journey) within 10 business days using the same payment method as the original transaction.

6.8 Please check your order immediately upon receipt. If there is any damage or a manufacturing defect, please report this to our customer service department within 48 hours of receipt at [customer service email address]. Please include clear photos of the damage, the packaging, and the product label. Our team will then work with you to find a suitable solution. This is the only exception to the exclusion of the right of withdrawal for personalized products.

6.9 The returns policy does not apply to products that have been delivered undamaged and correctly, as these are custom-made and personalized. A solution can only be offered in the event of demonstrable damage or a production or delivery error.

7. Warranty

7.1 CollageDepot offers a warranty on products as required by applicable law. The warranty period and terms may vary depending on the product and location. During the warranty period, we will repair any defects covered by the warranty free of charge or replace the product, at our discretion.

7.2 To make a warranty claim, you must contact our customer service and provide all necessary information, including a description of the defect and, if applicable, proof of purchase.

7.3 The warranty does not cover damage caused by improper use, accidents, normal wear and tear, or modifications or repairs performed by unauthorized parties. The warranty does not apply to products used for commercial purposes.

7.4 Our warranty is limited to the repair or replacement of the defective product and does not include compensation for consequential damages, loss of profits or other indirect damages.

7.5 Any warranty claims must be reported within a reasonable period after discovering the defect.

8. Liability

8.1 To the extent permitted by applicable law, we exclude all liability for any direct, indirect, incidental, special or consequential damages arising out of the use of our website, the placing of orders or the supply of products.

8.2 We are not liable for any delay or failure in the delivery of products caused by force majeure, including but not limited to strikes, natural disasters, war, terrorism, political unrest, government measures, or technical failures.

8.3 Our liability is in all cases limited to the amount you paid for the relevant products or services.

8.4 If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, this will not affect the validity and enforceability of the remaining provisions.
